Media Advisory: SAHRC issues a subpoena against the Mpumalanga Department of Human Settlements following non-responsiveness to issues relating to the Reconstruction and Development Programme (RDP) houses

The South African Human Rights Commission’s (SAHRC/the Commission) Mpumalanga Provincial Office (MPO) has exercised its authority as granted by section 15 of the SAHRC Act, in issuing a subpoena against the Mpumalanga Department of Human Settlements. This action is prompted by their non-responsiveness to issues relating to the Reconstruction and Development Programme (RDP) houses and multiple complaints lodged against the Department.

The initiation of the abovementioned investigative endeavour was prompted by several allegations of the failures of the Department to resolve housing issues and to eradicate asbestos roofs on previously allocated RDP houses. This significantly led to the violation of the rights of people to adequate housing and an environment that is not harmful to their health or well-being.

The Commission reaffirms its unwavering commitment to protecting human rights, ensuring accountability, and conducting comprehensive investigations into matters affecting people and communities. The issuance of subpoenas is a vital tool in ensuring accountability, transparency and the realisation of human rights enshrined in the Constitution.

The subpoena proceedings will be held as follows:
