Media Statement: The SAHRC briefs the Portfolio Committee on Justice and Constitutional Development

On Friday, 1 November 2024, the South African Human Rights Commission (SAHRC/ the Commission) engaged in a constructive briefing with the Portfolio Committee on Justice and Constitutional Development (PCJCD or Portfolio Committee). The focus was on key issues aimed at enhancing the Commission’s visibility and effectiveness in fulfilling its constitutional mandate.

One of the topics discussed was the precautionary suspension of the SAHRC’s Chief Executive Officer, Mr. Vusumuzi Mkhize, due to alleged misconduct. This matter is ongoing, and the Commission is committed to finalising the matter promptly while equally respecting the integrity of the process. Additionally, the Commission addressed complaints made against certain Commissioners and provided updates on various matters of interest to the Portfolio Committee.

The Commission appreciates the oversight and guidance from the Portfolio Committee. Importantly, the PCJCD expressed its commitment to supporting the Commission, underscoring the need to submit a comprehensive turnaround strategy or plan. The Commission will provide further information as requested, including a strategy to maintain stability within the institution. The Commission also welcomes the PCJCD's plans for oversight visits to its offices before the end of the year, further demonstrating the Committee’s dedication to transparency and accountability.

While we recognise several challenges affecting institutional performance in the last three years, we are encouraged by the results of the recent institutional audit, which indicates a positive trend in performance. The Commission is determined to build on this momentum. Recently, the Commissioners and the Secretariat participated in a strategic planning session, during which they identified strategies focused on the mandate and governance to strengthen both internal and external governance, while also enhancing visibility and overall impact. The Commission looks forward to collaborating with all stakeholders to achieve these objectives.

As an independent constitutional institution, the Commission values the opportunity for constructive dialogue with the PCJCD on important issues. We assure all stakeholders and the communities that we serve of our commitment to fulfilling our constitutional mandate impartially and effectively, free from internal or external obstacles.
